Terms of use

The Terms set out the rules that apply to anyone who visits the Site (the “User” or “you”). By accessing the Site, you acknowledge that you have read the Terms and agree to comply with them. If you do not accept them, please do not use the Site.

The Terms apply to the Site only. Other services or platforms published by HYVI LDA are governed by their own terms of use and privacy policies, including:

We may amend the Terms at any time, in particular to reflect changes to the Site or to applicable regulations. The version in force is the one published on this page; the date shown at the top of the page indicates its last update. Continued use of the Site after a new version is published constitutes acceptance of that version.

The Site is published by HYVI LDA, a company incorporated under Portuguese law with its registered office at Rua João Domingos Bontempo 117, 4445-476 Ermesinde, Portugal, registered under NIF/NIPC 516901559 (VAT PT516901559). Contact address: contact@hyvi.io.

The Site is available free of charge to anyone with Internet access. The equipment, connection and communication costs required for such access remain your responsibility.

We endeavour to keep the Site accessible at all times but are under no obligation to do so. Access may be suspended, restricted or interrupted at any time and without notice, in particular for maintenance, updates, security reasons, outages or events beyond our control. No unavailability of the Site gives rise to any right to compensation.

We may change, update or remove all or part of the Site’s content and features at any time.

You undertake to use the Site for its intended purpose and in compliance with applicable law. In particular, you must not attempt to gain unauthorised access to any non-public part of the Site or to our systems, hinder or disrupt its operation, alter its content, introduce malicious software, or extract or collect its content by automated means (scraping, harvesting, bulk indexing) without our prior written consent.

The Site and all of its elements (structure, text, images, illustrations, videos, animations, logos, icons, visual identity, code and databases) are protected by copyright, trade mark law and database rights, in particular under the Portuguese Code of Copyright and Related Rights (Código do Direito de Autor e dos Direitos Conexos), the Portuguese Industrial Property Code (Código da Propriedade Industrial) and European Union law.

These elements are owned by HYVI LDA or licensed to it. Unless otherwise stated, any reproduction, representation, adaptation, modification, distribution or exploitation, in whole or in part, by any means and on any medium, is prohibited without our prior written consent. Browsing the Site only grants you a private, non-exclusive right of access for personal use or internal information purposes.

The trade names, product names, domain names, visual identities, logos and other distinctive signs of the ecosystem presented on the Site, including HYVI, Blockunity, Stockunity, MagicEdge, Conforma, Noxalis Financial and Noxalis Lab, are trade marks or distinctive signs of HYVI LDA or of its affiliated entities, whether or not registered. Any reproduction, imitation, commercial use, misleading referencing or exploitation, in whole or in part, without prior written consent is prohibited. Other trade marks, product names or logos mentioned or displayed on the Site (including in the home film, interactive demonstrations or credits) belong to their respective owners and are cited or reproduced for illustrative purposes only, without any transfer of rights or implication of affiliation.

The typefaces used by the Site are distributed by their authors under the SIL Open Font License. They are not the property of HYVI LDA. Their full list and rightsholders appear in the legal notice.

The Site is intended solely for information and promotional purposes. It includes in particular an interactive home film, product demonstrations and presentation pages. The product descriptions, demonstrations, screenshots, charts, indicators, sample data, scenarios and animations shown on it are provided for illustrative purposes only, in order to present the features of HYVI LDA’s products. They may rely on fictitious, simplified, simulated or historical data and do not necessarily reflect real or current market conditions.

Nothing on the Site constitutes investment advice, an investment recommendation, financial analysis, a solicitation, an offer or an inducement to buy, sell or hold any financial instrument, crypto-asset or other asset. Nor does the Site provide legal, tax or accounting advice. HYVI LDA is not an investment services provider.

Investing in financial markets and crypto-assets involves significant risks, including the loss of the entire capital invested. Past performance, whether real or simulated, is not indicative of future results. Any investment decision is your sole responsibility and should be made, where appropriate, with the assistance of a duly authorised independent professional.

We endeavour to publish accurate and up-to-date information but do not guarantee its completeness, accuracy or currency. The content of the Site may be changed at any time.

The Site may contain links to third-party websites or resources, including the websites of the entities and products presented. These links are provided for your convenience. We have no control over such websites and accept no liability for their content, availability, personal data practices or any damage that may result from their use. The presence of a link does not imply endorsement or partnership.

You may link to the Site’s home page provided that the link does not damage the reputation of HYVI LDA or create confusion as to the origin of the content. We may request the removal of any link at any time.

The Site provides a contact form through which you can send us a request for information. By using it, you undertake to provide accurate information and to use it fairly, for enquiries relating to HYVI LDA and its products.

In particular, it is prohibited to send unsolicited, promotional, repetitive or automated messages, unlawful, abusive or defamatory content or content infringing third-party rights, or to impersonate another person. To prevent abuse, the form is protected by an anti-bot mechanism and by a limit on the number of submissions per period of time. We reserve the right not to respond to requests that breach these Terms.

Sending a message creates no contractual obligation on our part; we endeavour to reply within a reasonable time but do not guarantee a response.

HYVI LDA acts as controller of the personal data collected through the Site, in accordance with Regulation (EU) 2016/679 (GDPR) and Portuguese Law No. 58/2019. The processing carried out, its purposes, legal bases, retention periods, recipients and your rights are described in our privacy policy.

The Site is provided “as is”. To the extent permitted by law, HYVI LDA shall not be liable for any direct or indirect damage arising from access to or use of the Site, from the inability to access it, from the use of or reliance on the information it contains, or from any damage caused to your computer equipment by browsing the Site.

You are responsible for protecting your equipment and data, in particular against malicious software, and for the use you make of the information published on the Site.

Nothing in the Terms is intended to exclude or limit our liability where such exclusion or limitation is prohibited by applicable law, nor to deprive a consumer of the rights conferred by the mandatory provisions of the law of their country of habitual residence.

The Terms are governed by Portuguese law. Any dispute relating to their interpretation or performance falls within the jurisdiction of the courts of Porto (Portugal), without prejudice to mandatory jurisdiction rules and to the rights granted to consumers by the law of their country of habitual residence, in particular the right to bring proceedings before a court of that country.

Before taking any legal action, we invite you to contact us in order to seek an amicable solution. If you are a consumer, you may also refer the matter to a competent alternative dispute resolution body. The European online dispute resolution platform, historically available at https://ec.europa.eu/consumers/odr, is mentioned for information purposes; its availability depends on the European Union regulations in force.

If any provision of the Terms is held to be void or unenforceable, the remaining provisions shall remain in force. The failure of HYVI LDA to enforce any breach shall not constitute a waiver of its right to do so at a later date.
